These Terms & Conditions, including the End User License Agreement below (together, this “Agreement”), are a legal agreement between you and BarVibz IP, LLC (“we,” “us,” or “our”) governing your use of the BarVibz mobile application (the “App”). By creating an account or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.
You must be at least 21 years of age to create an account or use the App. By using the App you represent and warrant that you are 21 or older and that all registration information you provide is truthful and accurate. We may suspend or terminate any account that misrepresents age or identity.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on any Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the App.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You may delete your account at any time from Settings, which permanently removes your account and personal data.
The App allows you to post content, including reviews, photos, messages, events, and notes (“User Content”). You retain ownership of your User Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the App as needed to operate the service. You represent that you have all rights necessary to post your User Content and that it does not violate any law or third-party right.
We have no tolerance for objectionable content or abusive users. You agree not to post content that is unlawful, threatening, harassing, defamatory, obscene, hateful, or that infringes the rights of others, and not to use the App to bully, impersonate, spam, or exploit any person. Every piece of user content and every profile can be reported in-app, and users can be blocked. We review reports within 24 hours, remove content that violates these terms, and may suspend or permanently ban offending users without notice.
BarVibz helps you discover venues and connect with friends. We do not sell or serve alcohol, and we do not encourage excessive alcohol consumption. Always drink responsibly and comply with all applicable laws. Never drink and drive — the App offers ride options for a reason. You are solely responsible for your own conduct and safety when visiting any venue or event found through the App.
Core features of the App (discovering nearby venues, sharing your location with friends, check-ins, and safety features) use your device’s location while the App is open. You control location sharing per-friend in the App and can revoke location permission at any time in your device settings. See our Privacy Policy for details.
BarVibz may send you text messages for account verification (one-time passcodes) and, if you opt in, messages such as friend invitations and notifications about upcoming events or specials from venues you follow. Opting in to SMS notifications is not required to use the App, and consent to receive marketing texts is never a condition of any purchase.
Events, bar crawls, venue information, hours, and offers shown in the App may be created by other users or third parties and are provided for information only. We do not guarantee their accuracy and are not responsible for any event or venue, or for anything that occurs at one.
The App integrates third-party services, including map providers and ride-hailing deep links. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
The App, including its design, logos, wordmarks, and software, is owned by BarVibz IP, LLC and protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you.
We may suspend or terminate your access to the App at any time for conduct that violates this Agreement or is otherwise harmful to the service or its users. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including limitations of liability) survive.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARVIBZ IP, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED FIFTY DOLLARS (US $50).
This Agreement is between you and BarVibz IP, LLC only, not with Apple Inc. (“Apple”). Apple has no obligation to furnish maintenance or support for the App and is not responsible for any product warranties, claims relating to the App, third-party intellectual-property claims, or legal compliance. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
We may update this Agreement from time to time. Material changes will be communicated in the App, and the “Effective Date” above will be updated. Continued use of the App after changes take effect constitutes acceptance.
This Agreement is governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Orange County, California.
